The illegal immigrant conviction rate for “any crime” — which would be dominated by offenses requiring little or no prison time — is not meaningful due to undercount [18]. 3

Correctly interpreted, the DPS data suggests that illegal immigrants in Texas are convicted of homicide and sexual assault at higher rates than the state average. Significant uncertainties remain, however, especially regarding lesser offenses [18]. 3

If we counted only the illegal immigrants who were initially identified by DHS when arrested for homicide, the 2012 homicide rate (convictions divided by population) would be 2.7 per 100,000 illegal immigrants in the state [18]. This rate is lower than the state’s overall homicide conviction rate of 3.0 in 2012. However, once the illegal immigrants identified during their prison stays are added to the total count of illegals, their homicide rate rises to 3.9 per 100,000 in 2012 [18]. This rate is higher than the state average. 3

Increasing Requests for Federal Aid

Data on sanctuary jurisdictions and their rising requests for federal aid from 2021 to 2023:

Nearly $300 million was awarded to sanctuary jurisdictions in 2021, representing 43 percent of the funding awarded in the SCAAP, Byrne JAG, and COPS funding programs [19]. 4

The latest figures from 2023 indicate a continuation of this trend, with sanctuary jurisdictions receiving over $1.56 billion from three significant sources of law enforcement funding. This sum represents 29.34 percent of the $5.33 billion total available funds. 5

SCAAP: $126.8 million allocated to sanctuary jurisdictions out of $210.4 million available (60.29 percent). 5OJP: $1.21 billion allocated to sanctuary jurisdictions out of $4.46 billion available (27.25 percent). 5COPS: $222.8 million earmarked to sanctuary jurisdictions out of $662.9 million available (33.60 percent). 5

Historical Context of Migrant Crime

Custody Statistics

A total of 51,074 known or suspected aliens were in Bureau of Prisons (BOP) and U.S. Marshals Service (USMS) custody for a range of offenses at the end of the fourth quarter of FY19. Of those, 27,266 (53.4 percent) were confirmed aliens with orders of removal or who had agreed to depart voluntarily, 18,308 (35.8 percent) were still under investigation by ICE to determine alienage, 3,691 (7.2 percent) were aliens who were illegally present and under adjudication, and 936 (1.8 percent) were legally present and under adjudication [20]. 6

State-Specific Data

Arizona

In 2007, the Arizona state legislature passed the Legal Arizona Workers Act (LAWA) that mandated E-Verify on January 1, 2008 [21]. E-Verify is intended to prevent the hiring of illegal immigrants. The passage of LAWA may have increased the monthly flow of non-citizens into Arizona state prisons, but the effect was short-lived as many illicit immigrants either left the state or figured out how to get around E-Verify [21]. 6

Texas

According to DHS status indicators, over 437,000 criminal aliens have been booked into local Texas jails between June 1, 2011, and June 30, 2024, of which over 308,000 were classified as illegal aliens by DHS [22]. 7

Between June 1, 2011, and June 30, 2024, these 308,000 illegal aliens were charged with more than 533,000 criminal offenses which included arrests for 997 homicide charges, 68,104 assault charges, 9,643 burglary charges, 62,459 drug charges, 1,245 kidnapping charges, 26,900 theft charges, 41,616 obstructing police charges, 3,056 robbery charges, 6,744 sexual assault charges, 7,763 sexual offense charges, and 6,560 weapon charges. 7

DPS criminal history records reflect those criminal charges have thus far resulted in over 196,000 convictions, including 498 homicide convictions, 24,800 assault convictions, 4,881 burglary convictions, 25,815 drug convictions, 354 kidnapping convictions, 10,110 theft convictions, 16,321 obstructing police convictions, 1,704 robbery convictions, 3,228 sexual assault convictions, 3,537 sexual offense convictions, and 2,138 weapon convictions. 7

Throughout their entire Texas criminal careers, these 308,000 illegal aliens were charged with more than 741,000 criminal offenses which included arrests for 1,592 homicide charges, 92,183 assault charges, 20,811 burglary charges, 90,117 drug charges, 1,597 kidnapping charges, 42,396 theft charges, 62,710 obstructing police charges, 5,293 robbery charges, 9,218 sexual assault charges, 10,389 sexual offense charges, and 11,193 weapon charges. 7

DPS criminal history records reflect those criminal charges have thus far resulted in over 311,000 convictions, including 788 homicide convictions, 36,037 assault convictions, 10,471 burglary convictions, 41,831 drug convictions, 487 kidnapping convictions, 17,988 theft convictions, 27,693 obstructing police convictions, 2,839 robbery convictions, 4,653 sexual assault convictions, 5,143 sexual offense convictions, and 4,296 weapon convictions. 7

In 2019, illegal immigrants were 37.1 percent less likely to be convicted of a crime than native-born Americans in Texas [23]. There were 829 people convicted of homicide in Texas in 2019, of which 746 were native-born Americans, 42 were illegal immigrants, and 41 were legal immigrants [23]. The homicide conviction rate was 3.1 per 100,000 for native-born Americans, 2.2 per 100,000 for illegal immigrants (27.7 percent below natives), and 1.3 per 100,000 for legal immigrants (57.1 percent below natives) [23]. 8

July 2023 Crime Reports

An unidentified man died after being struck by two vehicles while walking in a travel lane on Lebanon Pike at Wellington Square in Nashville. Despite attempts by a Nashville Fire Department ambulance crew to persuade him to get out of the road, the man refused and cursed at them 9. A minute later, he was hit by a Honda Odyssey van and then by a second vehicle 9. The 61-year-old driver of the Honda returned to the scene, but the second vehicle’s driver fled 9. No charges against the Honda driver are anticipated as the section has a sidewalk and bike lane 9.

In Charlotte, North Carolina, two teenagers were arrested for a series of seemingly random drive-by shootings that killed Mustaffa Muhammad, 58, and wounded two other people 10. The shootings occurred between 1 a.m. and 1:30 a.m. on Tuesday, involving random shots fired from a vehicle at other vehicles or bicyclists 10. The 16-year-old suspect had plans to continue shooting people. At the same time, the 18-year-old, Carlos Roberto Diaz, faces charges including first-degree murder and attempted murder 10.

Victims’ Stories

In Bedford County, Virginia, Isauro Garcia-Cruz, an undocumented Mexican citizen, was charged with contributing to a minor for having consensual sexual intercourse with a 15-year-old girl from Honduras 11. The victim was an unaccompanied minor placed in a sponsor’s home by the U.S. Department of Health and Human Services, and the sponsor was also an undocumented immigrant 11. Garcia-Cruz faces additional warrants for aggravated sexual battery of a minor from a separate incident 11.

In Howard County, Maryland, ICE agents arrested Hassim Gumbo, a 25-year-old Chadian national convicted of accessory after the fact of murder in the first degree and unlawful possession of a firearm 12 13. Despite ICE lodging an immigration detainer, the Howard County Department of Corrections refused to honor it and released Gumbo 13. ICE Director Matthew Elliston criticized Howard County’s strict sanctuary policies, stating the frustration of everyone else cooperating except for one person, referring to Howard County Executive Calvin Ball 12.
